L.ILA.R reserves the right to amend the Terms and Conditions at any time by publishing a new version on this website. The Customer must log in using the email address and password provided during registration.<\/li><\/ul><ul><li>If the Customer loses or forgets their password, they can request a new one by logging into their account and clicking on \u2018Forgotten password\u2019. They will then receive their password at the email address provided when they registered.<\/li><li>Minors (under the age of eighteen (18) in France) who have not been emancipated, or adults who lack legal capacity, must refrain from registering on the Website. If it is subsequently established that the Customer is a minor who has not been emancipated or an adult lacking legal capacity, L.ILA.R will immediately cancel their registration and any ongoing relationship will be automatically terminated on the grounds of the false declaration initially made by the Customer.<ul><li><strong>Order:<\/strong> The Order relates to the products as they are presented on the Website (the \u2018Products\u2019). The Customer may place an Order online, via the online catalogue and using the form provided therein, for any Product, subject to availability.<\/li><li><strong>Summary and amendments:<\/strong> Any error in an Order may be rectified and the details entered by the Customer may be amended by the Customer by following the procedure described on the Website before confirming the Order (for example: the Customer may decide to change the quantity of Products they wish to purchase by adding or removing one or more items from their shopping basket). They must accept the T&amp;Cs in force on the date of the Order.<\/li><li><strong>Validation of the<\/strong> <strong>Order via<\/strong> <strong>The Client:<\/strong> In order for the Order to be confirmed, the Customer must select the delivery address, delivery method and payment method by confirming their choice (double-click) (the \u2018Confirmation\u2019). Confirmation of the Order is binding. The Customer may check the status of their Order online via their Customer Account.<\/li><li><strong>Conclusion of the contract:<\/strong> The contract between L.ILA.R and the Client is concluded upon confirmation of the<\/li><\/ul><\/li><\/ul><h3>\u00a0<\/h3><p><strong>Article 4 \u2013 The Products<\/strong><\/p><ul><li>On the Website, ILA.R reserves the right to limit, without prior notice, the quantities or types of Products available, as well as the styles, designs and colours of the Products described, in order to update its range.<\/li><li>The textual descriptions of the Products are accompanied by photographs. However, the photographs do not form part of the contract. As such, whilst ILA.R endeavours to represent the Products as accurately as possible through the photographs displayed on the Website, colour variations may occur, particularly due to the technical limitations of colour rendering on computer equipment. ILA.R shall not be held liable for any minor variation in the representation of the Products.<\/li><li>If necessary, the Customer should contact ILA.R with any specific enquiries, either by telephone or via the online contact form on the Website.<\/li><li>Should a Product be out of stock, the Customer will be notified of this when placing the Order, by means of a message stating that the desired Product is temporarily out of stock. L.ILA.R accepts no liability in the event of products being out of stock or unavailable.<\/li><li>Under no circumstances shall ILA.R be held liable for any error arising as a result of a failure in the Customer\u2019s connection to the Website.<\/li><\/ul><h3>\u00a0<\/h3><p><strong>Article 5 \u2013 The price, taxes and payment of the price\u00a0<\/strong><\/p><ul><li><strong>Price:<\/strong> ILA.R reserves the right to amend its prices at any time on the Website but undertakes to apply the current prices shown at the time the Order is confirmed, subject to the availability of the Products on that date. L.ILA.R shall inform the Customer of the total amount, including all taxes and charges, that they will actually have to pay (the Total All-Inclusive Price, hereinafter \u2018Price including VAT\u2019).<\/li><li><strong>Price accuracy: <\/strong>ILA.R carries out regular checks to ensure the accuracy of the prices of the Products listed on the Website. In the event of an error resulting in a price that is manifestly low, L.ILA.R reserves the right to cancel the Order.<\/li><\/ul><ul><li><strong>Terms of payment: <\/strong>The Customer shall pay the Price (including VAT) by credit\/debit card or PayPal.<\/li><\/ul><p><strong>\u00a0<\/strong><\/p><ul><li><strong>Payment via PayPal:<\/strong> The amount of the purchases will be automatically debited from the PayPal account.<\/li><li><strong>Payment by credit card:<\/strong> We accept credit cards from the Carte Bleue, Visa and MasterCard networks.<\/li><\/ul><p>To this end, the Customer confirms that they are the holder of the credit card to be debited and that the name appearing on the credit card is indeed their own. The Customer shall provide the sixteen-digit number and the expiry date of their credit card, as well as, where applicable, the security code. Payment of the Price (including VAT) must be made in a single instalment at the time of placing the Order.<\/p><p>The Customer expressly acknowledges that by providing their credit card details, they authorise L.ILA.R to debit their credit card for the amount corresponding to the price (including VAT) of the Products covered by the Order Confirmation.<\/p><p>In accordance with Article L. 133-8 II, paragraph 1, of the Monetary and Financial Code, a commitment to pay made by means of a bank card is irrevocable. The transaction is immediately debited from the Customer\u2019s bank card once the card details have been verified and authorisation to debit the card has been received from the issuer of the bank card used by the Customer.<\/p><p>Should it prove impossible to charge the price including VAT, the contract will not be performed and the Order will be cancelled.<\/p><p>Only upon full payment of the price, including VAT, shall title to the Products ordered pass to the Customer.<\/p><p>The Customer may, upon request, have an invoice sent to the billing address rather than the delivery address, by selecting the relevant option when placing the Order.<\/p><h3>\u00a0<\/h3><p><strong>Article 6 \u2013 Delivery of the Order\u00a0<\/strong><\/p><ul><li><strong>Delivery locations:<\/strong> The Products ordered are, at the Customer\u2019s discretion, delivered within the European Union and to Switzerland. The Customer must contact the Website in advance for any delivery outside the European Union. Products are delivered to the address provided by the Customer at the time of order confirmation. The Customer must ensure that this address is correct and is solely responsible for its accuracy. In the absence of any address details, or in the event of incorrect or incomplete details provided by the Customer, L.ILA.R shall not be held liable for any failure to fulfil or improper fulfilment of its delivery obligation. Any parcel returned to L.ILA.R due to an incorrect or incomplete delivery address will be re-dispatched at the Customer\u2019s expense. Should the Customer refuse to pay these additional re-dispatch costs, the Order will be automatically cancelled and the price of the Order will be refunded to the Customer\u2019s account, less any shipping costs incurred.<\/li><\/ul><ul><li><strong>Delivery terms:<\/strong> The Products ordered are delivered via the carrier selected by L.ILA.R. If the Customer is absent on the day of delivery, they will be notified of the delivery attempt either by the carrier or by ILA.R. The Customer may obtain further information via the Website.<\/li><\/ul><ul><li><strong>Delivery times:<\/strong> Delivery shall only be made once payment of the price (including VAT) has been confirmed by ILA.R. L.ILA\u2019s bank.R undertakes to fulfil Orders confirmed by the Customer and to deliver the Products ordered within 5 to 8 days, or 2 to 3 weeks for any orders requiring manufacture or customisation, from the date of Order Confirmation, except in cases of force majeure.<\/li><\/ul><p>L.ILA.R undertakes to inform the Client should any difficulties arise.<\/p><ul><li><strong>Checking your order on delivery:<\/strong> Without prejudice to the relevant legal provisions, if, at the time of delivery, the original packaging is damaged, torn or opened, the Customer, or their representative, must then check the condition of the<\/li><\/ul><h3>\u00a0<\/h3><p><strong>Article 7 \u2013 Returning Products<\/strong><\/p><ul><li><strong>Law<\/strong> <strong>from<\/strong> <strong>withdrawal<\/strong> <strong>:<\/strong> The Customer has a right of withdrawal, which they may exercise within fourteen (14) days from the day after receipt of the goods. If the period expires on a Saturday, Sunday or a public holiday or non-working day, it is extended until the next working day.<\/li><\/ul><p>The Customer may exercise their right of withdrawal by notifying the trader of their intention to withdraw, before the expiry of the aforementioned fourteen-day period, (i) either by sending the withdrawal form (a copy of which is attached hereto), duly completed and signed, (ii) or by sending a statement unambiguously expressing their intention to withdraw, to the following address: 205 Rue Saint-Honor\u00e9, 75001 Paris, France. The Customer may also complete and submit the withdrawal form or their statement via the Website.<\/p><p>The Customer must return the Product(s) no later than fourteen (14) days after notifying L.ILA.R of their decision to withdraw. The Product must be returned in accordance with the conditions set out in the section \u2018Product Return Policy\u2019. The direct costs of returning the Products shall be borne by L.ILA.R. L.ILA.R undertakes to send a Colissimo return label within 48 hours of receiving the request for an exchange or refund by email to <a href=\"mailto:info@lilar.fr\">info@lilar.fr<\/a> or by post to L.ILA.R, 205 Rue Saint-Honor\u00e9.<\/p><p>L.ILA.R shall refund the Customer, by any means of payment, the full amount paid, including delivery charges, within fourteen (14) days of the date on which it is notified of the decision to exercise the right of withdrawal. This refund will be deferred until the Products have been recovered or until the Customer has provided proof of their dispatch, in accordance with Article L. 221-24 of the Consumer Code.<\/p><p>The provisions relating to the right of withdrawal apply only to consumers as defined by the Consumer Code and, in any event, do not apply to legal entities.<\/p><ul><li><strong>Product Return Policy:<\/strong> Returns will only be accepted for Products in their original condition, complete with their original packaging, accessories, instructions and labels,<\/li><\/ul><p>L.I.L.A.R will not issue any refunds in the event of traces of sweat, deodorant, perfume, make-up, soiling or any damage, however minor, and may refuse a refund if the Customer states that they have already used (other than for trying on) the Product(s) or if L.I.L.A.R suspects that they have already used (other than for trying on) theProduct(s), even if the Product(s) are returned within the statutory return period (fourteen (14) days) following notification of withdrawal. The Products must be returned to the following address: 205, rue Saint-Honor\u00e9, 75001 Paris, France.<\/p><h3>\u00a0<\/h3><p><strong>Article 8: Guarantees<\/strong><\/p><ul><li>ILA.R hereby informs the Customer that the party responsible for ensuring the goods comply with the contract \u2013 and to whom a claim may be made under the statutory guarantee of conformity or the guarantee against defects in the goods sold \u2013 is the company L.ILA.R, situated at 205, rue Saint-Honor\u00e9, 75001 Paris, France.<\/li><\/ul><ul><li>ILA.R is liable for any failure of the property to conform to the contract in accordance with the provisions of Article<\/li><\/ul><ol><li>Articles 217-4 et seq. of the Consumer Code and hidden defects in the goods sold, in accordance with the conditions set out in Articles 1641 et seq. of the Civil Code.<\/li><\/ol><ul><li><strong>Statutory guarantee of conformity:<\/strong> Where the Customer is acting under the statutory guarantee of conformity, the Customer (i) has a period of two from the date of delivery of the goods in which to take action, (ii) may choose between repair or replacement of the goods, subject to the cost conditions set out in Article L. 217-9 of the Consumer Code, (iii) is not required to provide evidence of the existence of a lack of conformity in the goods for a period of twenty-four months following delivery of the goods, or six months for second-hand goods. The Customer may decide to invoke the warranty against hidden defects in the goods sold within the meaning of Article 1641 of the Civil Code. In such a case, they may choose between rescission of the sale or a reduction in the sale price in accordance with Article 1644 of the Civil Code.<\/li><\/ul><ul><li>ILA.R is obliged to deliver goods that comply with the contract and is liable for any lack of conformity existing at the time of delivery. It is also liable for any lack of conformity resulting from the packaging (Article L. 217-4 of the Consumer Code). The goods are in conformity with the contract (i) if they are fit for the purpose usually expected of similar goods and, where applicable, if they correspond to the description provided by L.ILA.R and possesses the qualities that the latter has presented to the Customer in the form of a sample or model, and if it possesses the qualities that a buyer may legitimately expect in view of the public statements made by L.ILA.R, by the manufacturer or by its representative, in particular in advertising or on labelling; (ii) or whether it possesses the characteristics defined by mutual agreement between the parties or is fit for any specific purpose sought by the Customer, which has been brought to the attention of L.ILA.R and which the latter has accepted (Article L. 217-5 of the Consumer Code).<\/li><\/ul><ul><li><strong>In the event of a lack of conformity:<\/strong> The Customer may choose between repair and replacement of the goods. However, L.ILA.R may not act in accordance with the Customer\u2019s choice if that choice entails a cost that is manifestly disproportionate to the other option, taking into account the value of the goods or the significance of the defect. In such cases, it is obliged to proceed, unless this is impossible, in accordance with the option not chosen by the Customer (Article L. 217-9 of the Consumer Code).<\/li><\/ul><ul><li><strong>If it is not possible to repair or replace the goods:<\/strong> The Customer may return the goods and receive a full refund, or keep the goods and receive a partial refund. The Customer has the same option (i) if the solution requested, proposed or agreed in accordance with Article L. 217-9 cannot be implemented within one month of the Customer\u2019s complaint, or (ii) if that remedy cannot be implemented without causing the Customer significant inconvenience, having regard to the nature of the goods and the use for which they are intended. However, the sale may not be rescinded if the lack of conformity is minor (Article L. 217-10 of the Consumer Code). The right to take action arising from a lack of conformity is subject to a limitation period of two years from the date of delivery of the goods (Article L. 217-12 of the Consumer Code).<\/li><\/ul><ul><li><strong>Hidden defects:<\/strong> These provisions do not deprive the Customer of the right to bring a claim arising from latent defects, as provided for in Articles 1641 to 1649 of the Civil Code (Article L. 217-13 of the Consumer Code). For any enquiries regarding statutory guarantees, the Customer may contact L.ILA.R via the contact form available on the Website, by post or on the telephone number shown in the header of this document.<\/li><\/ul><ul><li>The above provisions relating to the statutory guarantee of conformity and the guarantee against hidden defects apply only to consumers as defined by the Consumer Code, and in any event do not apply to legal entities. L.ILA.R shall therefore not be liable under the warranty against hidden defects in respect of legal entities.<\/li><\/ul><h3>\u00a0<\/h3><p><strong>ARTICLE 9 \u2013 Warning<\/strong><\/p><p>The sale of Items on the Website is exclusively reserved for retail sales and private individuals.Under no circumstances may the Website be used by professional sellers, whether acting alone or in groups, regardless of how they market their products (including, but not limited to, online marketplaces, shopping centres, intermediaries and physical shops).<\/p><p>The Customer therefore acknowledges and agrees that the Items may only be purchased in quantities corresponding to the average needs of a consumer, both in terms of the number of Items ordered in a single order and the number of individual Orders placed for the same product, provided that these do not exceed the quantity typically purchased by an average consumer. L.ILA.R reserves the right to refuse any order that is clearly placed by a Customer acting as a business-to-business seller.<\/p><p>All Customers acknowledge that they are aware of the unreliability of the Internet, particularly with regard to the relative security of data transmission, the lack of a guarantee of uninterrupted access to the Website, the lack of a guarantee regarding the volume and speed of data transmission, and the risk of virus transmission.<\/p><p>L.ILA.R advises all Clients of the need to install security software and measures on their computers, laptops or mobile devices to prevent the spread of viruses.<\/p><h3>\u00a0<\/h3><p><strong>Article 10 \u2013 Data<\/strong><\/p><p>L.ILA.R takes every possible measure to ensure the confidentiality and security of data transmitted via the Website.<\/p><ul><li><strong>Data recorded by the Sogecommerce payment service:<\/strong> Payment for purchases is processed via the secure platform of its partner, Sogecommerce. The data recorded and stored by the Sogecommerce payment service constitutes proof of the Order and of all transactions carried out. The bank details recorded by Sogecommerce constitute proof of the financial transactions.<\/li><\/ul><p>Consequently, the data recorded is intended to remain confidential, except in cases where it may be used as evidence of transactions carried out.<\/p><ul><li><strong>Personal data:<\/strong> The information collected is stored in a computerised database by L.ILA.R for the purposes of managing its customers and prospective clients. It is retained for three years and is intended for use by L.ILA.R\u2019s marketing and sales departments. In accordance with the French Data Protection Act, the Customer has the right to access, rectify and object to the processing of their personal data by contacting L.ILA.R, 205 Rue Saint-Honor\u00e9, 75001 Paris, France, <a href=\"mailto:info@loveislikearoseparis.com\">info@lilar.fr.<\/a>ILA.R informs the Customer of the existence of the \u2018Bloctel\u2019 cold-calling opt-out list, which they can join here: https:\/\/conso.bloctel.fr. The Customer has the right to set out instructions regarding the retention, erasure and disclosure of their personal data following their death by contacting L.ILA.R at 205 Rue Saint-Honor\u00e9, 75001 Paris, France, <a href=\"mailto:info@lilar.fr\">info@lilar.fr<\/a>.<\/li><\/ul><h3>\u00a0<\/h3><p><strong>Article 11 \u2013 Mediation<\/strong><\/p><ul><li><strong>In the event of a dispute:<\/strong> The Customer is entitled to refer the matter to a consumer ombudsman free of charge with a view to reaching an amicable resolution.
